This is Burges McCowan. In this video I want to talk about extreme and super extreme DUI.
In Arizona there’s actually multiple types of DUI and some of those are Extreme and Super Extreme based on your blood alcohol content level. If you have a ticket for DUI you might notice that you have a number of charges there. You’re going to see that there’s ARS 1381 – that’s for regular DUI. If you have a third charge, 1382, that’s an extreme DUI. If you have a fourth charge, also 1382, but it will say super extreme, well that’s the super extreme DUI.
The difference is just based on the blood alcohol content. If you’re above a 0.15 then that’s going to be extreme, and if you’re above a 0.2, that’s super extreme. Where that makes a big difference is in the punishment that the state’s going to want to mete out for those charges. With a 0.15 you’re looking at 30 days jail and for the 0.20, super extreme, you’re looking at 45 days jail. You can do some thing with counseling to get that reduced but those are the starting points for your jail. It can go up from there depending on your prosecutor so you definitely want to get an attorney that’s experienced in handling DUIs because you’re dealing with the lab work.
That’s specific scientific information that you need training for. Not just any attorney can handle that. They need to know the details for how this blood alcohol content is arrived at and what are the possible defenses for the way that that method is done. There are mistakes made in those labs but you need someone that knows how to look for those mistakes.
